Guidance for Kosovo Individual License Applicant

A end-user statement is required when applying for an individual license issued by the Ministry of Trade and Industry. This statement is part of the required supporting documentation for end-use control purposes that must be provided to the Ministry with a license application.

Please note that the Department for Control of Trade in Strategic Goods (STGD) generally will only accept statements as valid within six (6) months of the date of the application.

There are several types of statement forms available. The one you obtain in support of your application depends on how the items will be used.

 

If goods are being shipped, whether via a consignee or not:

 

  • For their end-use or if an end-user is incorporating the goods (i.e., installing them into another product or higher-level system), then you should obtain an end-user statement (EUS) form.
  • To be held in stock for future delivery or resale, then you should obtain a stockist end user statement (SEUS) form.

If the foreign company chooses not to use the relevant template, then you should advise them that the Ministry requires an original signed and dated statement in English on their letterhead providing the same information and assurances.

 

It is the Kosovo license applicant’s responsibility to ensure that:

 

  • The correct statement type – EUS or SEUS – is supplied with the license application to cover the relevant scenario. An incorrect statement type will not be accepted by the Ministry and will need to be resubmitted. This is likely to result in the application being delayed or returned without action.
  • All sections of the statement are completed legibly and in English (or accompanied by an authorized translation, including letterhead details, if written in a foreign language) by the end-user or stockist end-user on their original official letterhead (when the end-user is a company or a legal entity).
  • The statement form must be signed and dated by a person properly authorized by the end-user organization or stockist end-user organization to sign on their behalf. Digital signatures are not acceptable.
  • The same responsible official of the end-user organization or stockist end-user organization should also complete, sign, and date the statement and attach a cover letter (see Annex A to the EUS or SEUS form). This letter must be on their original, official letterhead. It should also be accompanied by an authorized translation, if written in a foreign language. If the end-user or stockist end-user is an individual, then the documents do not have to be on official letterhead.
  • The original of the relevant form and cover letter should be attached to the completed license application and submitted to the Ministry.
  • A copy of the EUS or SEUS, together with the cover letter, must be kept by the license applicant at its premises.
  • To reduce requests for information from the Ministry during license processing, the applicant should establish as part of its standard procedures whether the items are being shipped to an end-user or a stockist and forward the relevant guidance to them about which form to complete and how to complete it correctly.
  • If the STGD requests a revised EUS during processing of an application, it should include all of the EUS pages and be newly dated.
  • An applicant should be mindful of references to any unfamiliar abbreviations or acronyms, particularly those referring to consignees or end-users. To avoid requests for further information from the Ministry which might delay the application, acronyms should be spelt out in full.
