An end-user statement (EUS) is required when applying for an individual license to export chemicals listed in Schedule 3 of the CWC to states not party to the convention. This statement is part of the required supporting documentation for end-use control purposes, which is provided with a license application to the Ministry of Trade and Industry.
Please note that the Department for Control of Trade in Strategic Goods (STGD) generally will only accept statements as valid within six (6) months of the date of the application.
A list of countries that have ratified the CWC is available on the Organization for the Prohibition of Chemical Weapons (OPCW) website. The site also has a link to a list of non-CWC States Parties.
The end-user should use this EUS format for Schedule 3 chemicals. If the end-user chooses not to use this form, you may advise them that the Kosovo authorities require an original signed/dated statement, in English on their letterhead, containing the same information and assurances as specified in this EUS form.
It is the Kosovo licensee’s responsibility to ensure that:
- The correct certificate format is supplied with your export license application to cover the export of Schedule 3 chemicals to a state not party to the CWC. An incorrect statement type will not be accepted by the Ministry and must be resubmitted, which is likely to result in your application being delayed or withdrawn.
- All sections of the form are completed legibly and in English or accompanied by an authorized translation, if written in a foreign language, by the end-user on their original, official letterhead (in cases in which the end-user is a legal entity).
· The EUS for CWC Schedule 3 Chemicals form should be signed and dated by a person properly authorized by the end-user organization to sign on its behalf (the responsible official). Digital signatures are not acceptable.
· The same responsible official of the end-user should also complete, sign, and attach a cover letter (see Annex A to the CWC Schedule 3 EUS Form). This letter must be on their original, official letterhead. It should also be accompanied by an authorized translation, if written in a foreign language.
· The original CWC Schedule 3 EUS Form and cover letter should be attached to the completed export license application submitted to the Ministry.
· A copy of the CWC Schedule 3 EUS Form and cover letter should be kept by you at your premises.
· To reduce further requests for information from the Ministry during license processing, you are advised as part of your standard procedures to forward the guidance note to enable your end-user to understand how to complete the CWC Schedule 3 EUS form.
· If the STGD requests a revised CWC Schedule 3 EUS during processing of your application, it should include all of the respective EUS pages and be newly dated.
- Please note: You should not obtain either this EUS, the normal end user statement (EUS), or the stockist end user statement (SEUS) if the goods for export are chemicals listed in Schedule 2 of the Chemical Weapons Convention and you want to export them to states not party to the convention. CWC Schedule 2 chemicals are prohibited from being transferred to countries that have not ratified the convention.
Please be mindful of references to any unfamiliar abbreviations or acronyms, particularly those referring to consignees or end-users. To avoid requests for information from the Ministry that could delay your application, acronyms should be spelt out in full.
Guidance for End-Users to Complete the Template and Cover Letter
This end-user statement (CWC Schedule 3 EUS) form and Annex A must be provided when you order Schedule 3 chemicals that are to be used by you, whether shipped via a separate consignee or not. Both documents must be completed on your company’s letterhead.
Please read the following explanation of terminology carefully for guidance on completing the CWC Schedule 3 EUS form.
- The Kosovo licensee is the person or body who is exporting the chemical(s) abroad, which may be shipped directly to you or via a separate consignee.
- If unknown, the licensee’s reference can be left blank for completion by the licensee.
- The consignee is the person or body who is the first recipient of the chemical(s). This can be yourselves or it can be another person or body within your country or in another country. If you are both the consignee and the end-user, then you must enter your own details in boxes (c) and (d).
- As the end-user, you will receive the chemical(s) for end-use, so boxes (e) and (f) must be completed.
- The end-user in this section refers to the entity at the time of export from Kosovo.
- The goods in this section refer to those at the time of export from Kosovo.
- The Kosovo authorities must be able to understand what the chemical(s) is/are and to be able to compare it/them with the chemical(s) described in the Kosovo exporter’s license application. A detailed description of the main chemical or chemicals is required. Please provide as much information as possible, such as trade names and common names.
- If the chemical(s) is/are to be used in the production of another chemical or end-product, then that chemical and/or product and its use also should be described.
- Section 4 must be signed and dated by you as the end-user, since you will use the goods identified in Section 2. This section should be signed and dated by a person within your organization with authority to sign on behalf of the company/organization. Digital signatures are not acceptable.
- Section 5 must be signed and dated by an authorized signatory for the government of the recipient state, along with a government department/ministry stamp.
