The Minister of Economy, Employment, Trade, Industry, Entrepreneurship and Strategic Investments, Rozeta Hajdari, has signed an ORDINANCE on the performance of economic activities during the public health emergency that all economic operators are ordered to implement it.

The Minister of Economy, Employment, Trade, Industry, Entrepreneurship and Strategic Investments, pursuant to Articles 10, 11 and 17 of Law No. 06 / L-113 on the Organization and Functioning of the State Administration and Independent Agencies, Article 8, paragraph 1.4 and Annex 8, items 20, 30 and 31 Regulation (GRK) No. 05/2020 on Areas of Administrative Responsibility of the Office of the Prime Minister and Ministries, and Decisions no. 01/09 of 13 March 2020 and No. 1/11 of 15 March 2020 of the Government of the Republic of Kosovo, hereinafter referred to in Law No. 2004/18 on Internal Trade, as amended, and having in mind the requirements of the National Response Plan and the recommendations of the National Institute of Public Health, issues this :
ORDINANCE
on the performance of economic activ during the public health emergency
1. All economic operators are ordered to:
1. implement the decisions of the Government of the Republic of Kosovo, no. 01/09 of 13 March 2020 and no. 1/11 of March 15, 2020, regarding measures against the pandemic of COVID-19 coronavirus and related public health emergency; and
2. act according to this ordinance, with ordinance No. 01/01 of March 12, 2020 and No. 01/02 of 17 March 2020, as well as other orders that the Ministry may issue regarding public health emergency.
2. Every economic operator should take these hygienic and preventive measures:
1. disinfect and ventilate the workspace premises regularly;
2. equip workers with personal protective equipment, as directed by the Ministry of Health (MoH) and the National Institute of Public Health (NIPH);
3. take measures for social distance and avoid contact, both employees and clients, as recommended by the Ministry of Health (MoH) and the National Institute of Public Health (NIPH),
4. use as much as possible electronic channels to carry out the activity, including the sale of goods and services.
5. take other measures necessary to implement Government decisions regarding health emergencies.
3. Closure of shopping malls (operating in open and closed environments, including bazaars [1]), except pharmacies (medical and agricultural) and grocery stores in these shopping malls.
4. Closure of gastronomic activities: bars, pubs, cafeterias, public kitchens, kebab shops, restaurants, and other beverage and food service activities, to serve walk-in clients;
1. These operators must demobilize the tables and chairs used for service within their premises and should close the doors to visiting clients.
2. To these operators take-away service is prohibited [2].
3. However, these operators are permitted to distribute their products / services by delivery.
4. No person other than the staff shall be permitted to stay within the premises of these operators. Premises, personnel and means of transport engaged in the preparation and delivery of orders to customers shall be treated with rigorous hygiene measures, as referred to in point 2. when preparing and delivering products, measures of social distance and avoidance of contact must be strictly respected.
5. At shops, food markets, bakeries, medical and agricultural pharmacies, gas stations, car-wash, utilities and financial services, and any other activities that are permitted to work:
1. Must close corner cafeterias as well as “take-away” of drinks and food. Vending machine will be removed. But delivery of ordered products/services is permitted.
2. At gas station and car washes, the food market, lubricants and accessories shop are permitted to work, but will be closed the gastronomic activity (drinks and food) as well as ”Take-away”. Vending machines will be removed. But delivery of ordered products/services is permitted.
6. Food and beverage service is prohibited inside the dining hall. The employer must ensure the distribution of suitable foods to be consumed at the workplace/workspace.
7. All gastronomy activities in hotels are prohibited. Guests can be served with suitable food for consumption in their rooms. The hotel must ensure that it has accurate customer information, including the country of origin. The hotel must take action in accordance with the instructions provided by the Ministry of Health.
8. Special operators dealing with municipal, financial, electronic and postal services may provide reasonably organized schedule and staff services, in accordance with the measures in force for public health emergencies (referred to in point 1).
9. Distribution of printed promotional materials, such as leaflets, coupons, catalogs, etc. is prohibited.
10. Mobile sale of food, beverage and vending machines are prohibited in public places and within the premises of various economic operators. [3].
11. Manufacturers, processors, constructions and other commercial and service activities (not mentioned in this directive) may exercise their activities by taking the measures referred to in points 2.1, 2.2, 2.3 and 2.5.
12. It is the duty of the market inspectors and labor inspectors throughout the Republic of Kosovo to consider with priority the cases related to the implementation of the decisions and orders referred to in point 1.
13. The Ordinance No. 01/03 of 17 March 2020 has been supplemented and amended.
14. This ordinance shall enter into force on the day of signature.
