MIET issues a decision on the termination of consumer contracts with cable operators

The Ministry of Industry, Entrepreneurship and Trade (MIET), through the Central Market Supervision Inspectorate (CMSI), after reviewing hundreds of consumer complaints received by the Consumer Protection Department regarding cable network services, has issued a decision obliging cable operators to remove unfair terms in contracts, granting consumers the right to terminate the contract if the operator has failed to fulfil obligations according to the contract.

The obligation imposed on consumers upon signing the contract to pay the remaining part of the contract even if there have been changes in the service/content of channels, is in contradiction with Article 72, paragraph 1, subparagraph 1.15 of Law No. 06/L-034 on Consumer Protection, specifying that the “Terms considered unfair are those terms that have the purpose or effect of: Obliging the consumer to fulfil all his obligations where the seller or supplier does not perform his."

The Ministry of Industry, Entrepreneurship and Trade remains committed to protecting the rights of all consumers, therefore, it thanks them for their trust by sending all their complaints to the Consumer Protection Department within MIET for further review by the Central Market Supervision Inspectorate and other responsible institutions, with careful handling of each complaint coming from citizens, respectively consumers.
