MINT in consumer protection for cable telecommunication services

Market Inspectorate Inspectors of the Ministry of Industry, Entrepreneurship and Trade (MIET), during September 2021 have received over 180 complaints from consumers, who have complained about the cable telecommunication services provided by an economic operator.

Based on article 9, paragraph 1, point 1.3, of Law No. 03/L-181 on Inspectorate and Inspective Supervision, market inspectors have inspected the economic operator, in which case they analysed the documentation submitted by the economic operator, customer complaints, and material evidence. Thus, based on these evidence it has resulted that the economic operator has committed violations against consumers.

According to Law No. 06/L034 on Consumer Protection, specifically articles 13, 71, 72 and 73, the economic operator has committed violations, such as:

Has made deceptive advertisements for clients/customers by promoting services that it does not offer or was aware in advance that it could not offer;

Without warning and without any prior notice, it has stopped broadcasting some channels, which has pushed a large number of consumers to file a complaint claiming that they have been deceived.

It has imposed unfair conditions in the contract, conditioning the client/customer that in case of termination of the contract before the deadline of 12 months, the client/customer is obliged to pay for the remaining months, even though he is not able to use the services for which has entered into the contract.

The Market Inspectorate, on 23.09.2021, has initiated a request for initiating minor offence proceedings before the Basic Court in Prishtina for the economic operator and it is expected that this case will be treated with priority and in accordance with applicable legal provisions.
