PUBLIC NOTICE

The Ministry of Industry, Entrepreneurship and Trade (MIET) informs the public opinion regarding the Administrative Instruction (MIET) 06/2024 on Determination of Rules and Procedures for the Administration of Import Quotas

In order to provide fair public information and transparent decision-making, the Ministry of Industry, Entrepreneurship and Trade announces to the public that:

Administrative Instruction (MIET) 06/2024 on Determination of Rules and Procedures for the Administration of Import Quotas, signed on August 6, 2024, has been drafted pursuant to Law No. 08/L-021 on Foreign Trade.

This administrative instruction is in accordance with international practices, World Trade Organization agreements and European Union legislation. Based on the principles of the World Trade Organization, import quotas can be established mainly for the seasonal protection of certain products.

Administrative Instruction (MIET) 06/2024 explicitly establishes that only in the case of import restrictions that include the establishment of tariff quotas, by decision of the Government of the Republic of Kosovo, after a detailed, documented and detailed analysis, a notice on the application of certain quotas in imports should be announced, in the time period for the administration of the respective quotas, only in cases where it is proven that there is excessive import, which damages local production, for a certain time, respectively during certain seasons. In such cases, there must be a public notice on the total quantity, value, volume or weight of the product, and the method of establishing tariff quotas, the time limits for validity, the rules and procedures for the non-discriminatory administration of import quotas are clearly defined.

When applying quotas, all economic operators who apply for tariff quotas will have equal treatment, with criteria and correct distribution of import products.

The approval of Administrative Instruction (MIET) 06/2024 completes the legal framework within Law No. 08/l-021 on Foreign Trade, which defines the general principles that regulate the foreign trade of the Republic of Kosovo, in accordance with the best international practices, the agreements of the World Trade Organization and the relevant legislation of the European Union.

Administrative Instruction (MIET) 06/2024 legally regulates the correct implementation of the provisions on tariff quotas, and the non-discriminatory administration of restrictions on imported products.

This administrative instruction does in no way affect households in Kosovo, does not favor economic operators, and does not affect the limitation of regular operation in the country's free market.

It is worth noting that Administrative Instruction (MIET) 06/2024 has passed all legislative procedures and public consultations with stakeholders, including ministries and other relevant institutions, the business community and the Kosovo Chamber of Commerce (KCC).

The Ministry of Industry, Entrepreneurship and Trade (MIET) will continue to work on creating an environment for doing fair, adaptable and competitive business, as well as promote the free movement of goods and services in accordance with international agreements between Kosovo and other countries.
